Terms & Conditions
DeliveryDuring the period May to September we are unable to despatch to any location that is a 2 day delivery. To minimise the time in transit of our food products, our delivery days are Tuesday, Wednesday and Thursday, between 8am and 6pm. Orders are dispatched to arrive on the day you specify provided we receive it at least 5 days in advance. We deliver by overnight couriers for delivery to UK mainland addresses (excluding Highlands and Islands), at busy times of year this service can take 2 days. Please ensure someone is available to receive, sign for and put your purchase in a cool place. Increasingly customers seem to find it most convenient to have their parcels sent to a work address. If this is not possible you may, at your risk, use the “Delivery Instructions” which you will see when you complete your order to give instructions, such as “leave in the garage if out” (choose a cool place). If so, we can not accept responsibility for the condition of the goods or non receipt. Any delay in despatch and/or delivery for whatsoever reason shall not be grounds for a claim for consequential loss.
Packing and PostageThe Shopping Cart automatically calculates the Shipping Charges for all locations. UK mainland delivery charge (excluding Highlands and Islands) is £10 per delivery address whatever the size of the order. For all addresses outside this area or overseas a carriage charge will be shown on screen before you send your order. The majority of our products are not available for overseas delivery. Paxton & Whitfield will not be held responsible if local Customs Authorities wish to charge import duty or delay the release of any item.
PricesPrices quoted are by weight or by unit as appropriate and include all taxes applicable to sales in the UK. The company makes a charge for delivery which is specified on the web-site. The company reserves the right to alter any prices or specifications at any time without notice and all goods are sold subject to prices ruling at the date of despatch. Subject to the above, customers will be notified if the price to be charged is different from the published price and will be given the option of cancelling their order without penalty.
PaymentPayment must be received by us before an order can be processed. We accept payment on line by Visa, MasterCard, Switch and Delta. Your payment is processed via a fully authorised Payment Service Provider

(SECPAY) which ensures that all your information remains totally confidential. SECPAY is fully accredited with Barclays Merchant Services who authorise your card for payment.
In the event that any payment is subsequently dishonoured any amount due will be chargeable with interest at the rate of 4% per annum over the base rate of Barclays Bank PLC appertaining at the date on which payment falls due notwithstanding that such claims to interest and/or surcharges for non-payment may have been waived by us in the past. We reserve the right to re-impose without notice any discount that may have been allowed if payment is not made in full by the due date. All costs including legal fees incurred in collection of amounts due or in enforcing under the Title clause below will be payable by the customer.
Cutting and WeightsCutting cheese accurately to a given weight is a real art; we don't use machines to cut the cheese it's all done by our cheesemongers by hand! We always endeavour to get as close to the quantity ordered as possible, if we go 'under' on one item we'll try and make up for it on another. The same is true of individual cheeses, being handmade again the weights are approximate, a 'whole truckle' described as 1.8kg could be more or less than that.
Substitutions and ReturnsPart of the attraction of artisan food is that it varies from season to season. From time to time we may not be happy with a particular product or it may not be available. In this case we may substitute something we consider equally good or better. Every care has been taken to ensure accurate descriptions have been given.
Please notify us within 24 hours of your excepted delivery date if you have not received the order or are unhappy with it in any way. Should you wish to return a product, please telephone our Mail Order team on +44 (0)870 2642101.
Many of the products that we sell are perishable and may therefore not be required to be returned to us after delivery. Products which are required to be returned will be returned at the customer’s expense and, provided they are returned in good condition within 10 working days of original receipt, a credit will be issued for the price paid. If they are not so returned, we may arrange for collection of the goods and any costs incurred by us will be deducted from any refund.
The points above do not affect your statutory rights.
Cancellation of OrderPaxton & Whitfield reserve the right not to accept or to cancel once accepted any order, without penalty. The customer may cancel an order without penalty only before we have processed it.
TitleAll rights of ownership and to possession of the goods supplied shall remain in and belong to Paxton & Whitfield Ltd until full payment has been received for the goods. In the event of non-payment Paxton & Whitfield has the right, without notice, to enter any premises owned or occupied by the buyer in order to recover all or any of the goods. Repossession of the goods by Paxton & Whitfield shall be without prejudice to any other remedy of Paxton & Whitfield ltd. The buyer agrees to keep the goods identifiably the property of Paxton & Whitfield Ltd and to keep them stored in merchandisable condition. The goods will be held by the buyer as bailee and agent for Paxton & Whitfield until payment in full has been made. In the event of sale of the goods prior to payment of the price in full, the buyer shall hold the proceeds of the sale as an agent of Paxton & Whitfield Ltd until payment in full has been made.
RiskRisk of damage or deterioration to the goods supplied passes to the buyer on delivery. No claim for damage or deterioration after delivery can be accepted.
Pilferage and DamageWe can only accept claims for pilferage or damage if written notification is given to both the carriers and ourselves within three days of receipt of goods. If delivery is made by carriers please always sign for the goods “unexamined” and retain the outer wrappings for examination by the carrier. If delivery is made on our own transport, the consignment should be checked and signed for accordingly.
QuotationsAll quotations given by the company are subject to market fluctuations etc and are made without engagement.
Contract TermsWe shall supply goods only on the condition that these terms and conditions represent the entire agreement between ourselves and our customers and these conditions superseded any prior agreement or arrangement.
Variations of Terms and ConditionsNo variation may be made to these terms & conditions unless agreed in writing by a Director of Paxton & Whitfield Ltd. Orders placed by our customers shall be only on that basis that our customers acknowledge that they are not relying on any representation regarding goods supplied other than as may be in writing and signed by a Director on behalf of Paxton & Whitfield.
